1. Agreement
These Terms of Service ("Terms") are a legal agreement between you and Fablespin Ltd ("Fablespin", "we", "us", "our") governing your use of the Fablespin iOS app and related services (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
2. Who may use Fablespin
The Service is intended for use by parents and legal guardians to create stories for children in their care. You must be at least 18 years old (or the age of majority where you live) to download the app, create an account, or purchase a subscription. By using the Service you confirm that you meet this requirement and that you are the parent or guardian of any child for whom you create a profile, and that you consent on that child's behalf to the use of the Service. Children should use Fablespin only under the supervision of a parent or guardian.
3. Your account
You sign in to Fablespin using Sign in with Apple. You are responsible for maintaining the security of the device and Apple ID used to access the Service, and for all activity that occurs under your account. The information you provide must be accurate.
4. The Service and subscription tiers
Fablespin lets you generate personalised AI bedtime stories. The Service is offered in a free tier and in paid subscription tiers. The features, narration options, illustration options, and any usage limits of each tier are described in the app at the point of purchase. The paid subscriptions are:

Prices are in pounds sterling and may differ in other regions and currencies based on Apple's pricing. We may change prices and the features of each tier; if we change the price of a subscription you already hold, Apple will notify you and, where required, ask you to consent before the change takes effect.
5. Subscriptions, auto-renewal, and free trials
All subscriptions are purchased and managed through your Apple App Store account. The following terms apply:
- Auto-renewal. Subscriptions are auto-renewable. Your subscription automatically renews for the same period (monthly or yearly) at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period.
- Billing. Your Apple account is charged for renewal within 24 hours before the end of the current period.
- Free trial. The Fablespin Family (Monthly) plan includes a 7-day free trial for eligible new subscribers. If you do not cancel at least 24 hours before the trial ends, the trial automatically converts to a paid monthly subscription at £5.99/month and your Apple account is charged. If you purchase a subscription before a free trial ends, any unused portion of the trial is forfeited. The free trial applies to the Family Monthly plan only, not to the annual or Premium plans.
- Managing and cancelling. You can view, manage, upgrade, downgrade, or cancel a subscription, and turn off auto-renew, at any time in your App Store account settings (Settings → your name → Subscriptions on your device). Deleting the app does not cancel a subscription.
- Changing tiers. You can move between subscription plans. Apple applies any upgrade, downgrade, or proration according to its own rules; changes generally take effect at the start of the next billing period unless Apple specifies otherwise.
6. Payment, refunds, and cancellation
Payment is processed by Apple, not by us. We do not receive or store your payment card details.
Refunds are handled by Apple under the App Store's terms. We cannot grant refunds directly. To request a refund, contact Apple Support or use Apple's "Report a Problem" page. If you cancel, you will continue to have access to your paid tier until the end of the period you have already paid for, and you will not be charged again. Nothing in these Terms removes or limits any statutory consumer rights you have under the law of your country, including any mandatory cancellation or refund rights.
7. AI-generated content
Fablespin stories, narration, and illustrations are generated by artificial intelligence based on the details you provide. We apply content-safety measures designed to keep stories age-appropriate. However, AI-generated content can be unpredictable, and we cannot guarantee that every story will match your expectations or preferences.
We recommend that a parent or guardian reviews stories before sharing them with a child. If you ever encounter content you consider inappropriate, please stop using that story and report it to us at support@fablespin.app so we can improve our safeguards.
8. Acceptable use
You agree to use the Service only for its intended purpose: creating bedtime stories for children in your care. You agree not to:
- use the Service to generate content that is unlawful, harmful, hateful, sexual, or otherwise inappropriate, or that attempts to circumvent our content-safety measures;
- reverse-engineer, decompile, interfere with, or attempt to gain unauthorised access to the Service or its underlying systems;
- use the Service in any way that infringes the rights of others or violates any applicable law; or
- resell, redistribute, or commercially exploit stories or other content generated by the Service beyond personal, family use.
We may suspend or terminate access to the Service if you breach these Terms.
9. Intellectual property
The Fablespin app, its name, design, and underlying software are owned by us and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use the app for personal, non-commercial family use, subject to these Terms. Stories, narration, and illustrations generated for you are provided for your personal family use. To the extent we hold any rights in that generated content, we grant you a personal licence to use and enjoy it with your family.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your requirements. The Service depends on third-party platforms (including Apple, and our AI and hosting providers); we are not responsible for failures or interruptions caused by those third parties.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.
12. Termination
You may stop using the Service and delete your account at any time from within the app (Settings → Account → Delete Account). We may suspend or terminate the Service, or your access to it, if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including Sections 9–11) will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after a change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules. Any dispute will be subject to the courts of England and Wales, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.
15. Apple-specific terms
You acknowledge that these Terms are between you and us, not with Apple, and that Apple is not responsible for the Service or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them. Your use of the app must also comply with the Apple Media Services Terms and Conditions.
